By accessing or using Smart Table (“Platform”, “Service”, “we”, “our”, or “us”), you agree to be bound by these Terms of Service.

If you do not agree to these Terms, you must not use the Service.

These Terms apply to all users, including restaurant owners, administrators, staff, and end customers accessing digital menus.


2. Description of Service

Smart Table is a cloud-based restaurant management system that may include:

  • QR Code Digital Menus
  • Online Ordering
  • POS & Order Management
  • Kitchen Display System (KDS)
  • Payment Gateway Integrations
  • Reporting & Analytics
  • WhatsApp / SMS Notifications
  • Subscription-based plans

We reserve the right to modify, update, or discontinue features at any time.


3. Account Registration

To use certain features, you must create an account.

You agree to:

  • Provide accurate and complete information
  • Maintain the confidentiality of your login credentials
  • Be responsible for all activities under your account

We are not liable for losses caused by unauthorized use of your account.


4. Subscription & Payments


4.1 Subscription Plans

Access to Smart Table may require a paid subscription (monthly, annual, or lifetime if applicable).


4.2 Billing

  • Fees are billed in advance.
  • All payments are non-refundable unless otherwise stated.
  • Failure to pay may result in suspension or termination.


4.3 Payment Providers

Payments are processed through third-party payment gateways.
We are not responsible for errors, downtime, or issues caused by payment providers.


5. Restaurant Responsibilities

Restaurant owners agree to:

  • Comply with all applicable local laws and regulations
  • Maintain accurate pricing and tax settings
  • Ensure lawful handling of customer data
  • Take responsibility for orders, food quality, and fulfillment

Smart Table provides the software only and is not responsible for restaurant operations.


6. Customer Orders

Smart Table facilitates digital ordering between customers and restaurants.

We:

  • Do not prepare food
  • Do not guarantee product availability
  • Are not responsible for disputes between customers and restaurants

All fulfillment responsibilities remain with the restaurant.


7. Acceptable Use

You agree not to:

  • Use the platform for illegal activities
  • Attempt to hack, reverse-engineer, or exploit the system
  • Upload malicious code or harmful content
  • Interfere with system security

Violation may result in immediate termination.


8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy.

Smart Table acts as:

  • Data Controller for account/subscription data
  • Data Processor for restaurant customer data

Restaurants are responsible for compliance with applicable data protection laws.


9. Intellectual Property

All platform content, software, branding, and technology belong to Smart Table.

You may not:

  • Copy
  • Resell
  • Redistribute
  • Modify
  • Create derivative works

Without written permission.


10. Service Availability

We aim to provide high availability but do not guarantee uninterrupted service.

We are not liable for:

  • Server downtime
  • Hosting issues
  • Internet disruptions
  • Third-party API failures (e.g., WhatsApp, payment gateways)


11. Limitation of Liability

To the maximum extent permitted by law:

Smart Table shall not be liable for:

  • Loss of profits
  • Data loss
  • Business interruption
  • Indirect or consequential damages

Our total liability shall not exceed the amount paid by you in the last 3 months.


12. Termination

We may suspend or terminate accounts if:

  • Terms are violated
  • Payments fail
  • Fraudulent activity is detected

Upon termination:

  • Access will be revoked
  • Data may be deleted after a retention period


13. Modifications to Terms

We may update these Terms at any time.

Continued use of the Service after changes means acceptance of updated Terms.


14. Governing Law

These Terms shall be governed by the laws of:
